I and the lawyer studio failed the first request for a VISA. I didn't like their way to work and all the money they asked ( 12000 USD for nothing) so I am looking for alternatives.
Is it my right to have back FOR FREE all the documentation they have collected ?

Hello,
My labour got approved but we still have to file for I-140. My h1b is going to expire on May 2007.
Can I get H1b extension based on Labour approval? If not, is it necessary to file I-140 soon.

yes, if your labor was filed more than a year ago you can get an extension. However I would advice you to first only file 140. get it approved. these days it is fast. and then apply for h1b extension in january. you will be able to get 3 yr extn instead of 1 year. it will save you much extension headaches and legal fees.hope this helps.

If the employer is not willing to share your I-140 approval status with you, is there a way to find out this information from other sources?
I currently have my 485 & AP numbers but do not have I-140 number to track on the USCIS website.

As long as you are fulfilling your obligation to work full-time with your H1-B employer, there should be no problem to do additional work in your home country in your spare time (I am assuming that you will do that remotely) from an immigration point of view. However, it is a complex situation tax-wise. In general you do have to report that overseas income in your tax return and pay tax on it. Things get even more complicated if you do not bring the income back to US but keep it in your home country ...

I have a very complicated case, and I need some answer that can release me from all this stress.
I came to the United States country in 2007 with a F1 visa. I won a scholarship sponsored by the government of my country to complete a bachelor degree. I was sent to a community college to improve my English skills. I finished my associated degree at the community College last spring 2009. Since my school only issued the I-20 until June 2009, my visa was also issue until that date. Therefore, my visa is already expired. However, already got accepted into a 4 year college and I am starting in Fall 2009, so I am still under F1 status.
The institution that is sponsoring my scholarship agreed to pay for my bachelor. However, they are requesting all scholarship students to change their status to j1 by the beginning of spring 2010. If I don't do it, I will lose my scholarship and therefore my status since I don't enough money to pay for the very expensive tuition. The institution wants us to go back for two years after we finish our bachelor, so they forcing us to change our visas.
I have been living with my girlfriend since last year. She is a Permanent Resident since 2003 . She is planning to apply for citizenship on February 2010. We are planning to get married by the end of this month (August). I need to go back to my country to change my status to j1 by the end of the fall semester, so I can keep my scholarship.
Here are my questions:
Might getting married now increase the risk of been rejected when apply for J 1 visa?
When would be the best time to get married?
When would be the best time to apply for green card? (Summit I-130, I-485, I-765 and G-325)

It is certain that the politicians will not touch the immigration topic in the next one year. Even after best efforts of the president the immigration bill failed in the senate few months ago.
One and only one thing that can be tried before Nov 2008 is the recapture of visa numbers from the last five years. I think IV should push for that.
Other than the above not much can happen, get ready for really long cold winter and then a looong hot summer. I wish things were better.

yeah it does seem a bit un-alive. but i'm glad you like it man. Kirupa usually writes back and says - i've added it up when he likes a stamp. He will in time, no doubt but because of various contests that are taking place, perhaps he is very busy. In fact I am trying to think up a competition for him at the moment, but they all seem to have been done at some point in the past - t shirt etc. Perhaps the most obvious idea for a competition on a forum such as this would be a web page design? give people some guidlines and let them design a nice webpage in a sort of css style - but give them a title or ficticious company (perhaps something like - The new official site for Elvis and Graceland) - even if it is not an actual scripted site in html - only a jpg? but god knows who would give out prizes for such a contest. In the recent magazine cover competition (which i am a judge for) someone has offered considerable prizes. Maybe Kirupa could contact lisa marie and ask her ;)

I am graduate student in Clinical Psychology. I am going to be working for a state employer during summer. This is mandatory for my program and I will receive 6 credits for it by the end of summer. However, due to some graduate school rules, I will have less than minimum credits to take during the Fall '10 and Spring '11 semesters. I was wondering if I could go ahead and work on CPT during summer (the employment is not paid), but register for those credits during Fall '10 and Spring '11 (breaking it up into 3 credits each) which will ensure my minimum registration.
Also, can I apply for CPT during a semester when I have taken minimum credits required and I am a TA (full 20 hours)?

I am from Pakistan and I do have Canadian PR also. I applied I-824 on August 5, 2008 and it got approved very fast on January 16, 2008 IN just 5 and half months and I have written that I want to process my case in Toronto Canada not from Pakistan now I have the following question
1-on approval notice the petitioner name and the beneficiary name is the same don�t u guys thing the beneficiary name should be my wife name
2-DO all FTJ cases are processed through NVC. Or only some of them... because Islambad embassy accept cases from NVC only they told me that I-824 has to be approved and then UCIS will send your case to NVC and then case will be sent to islamabad but is this the same procedure for canada because I-824 approval notice says that they have notified tornto consulate that I am the permenant resident thats all. I 824 do not have even my wife name?? Can any body tell me clearly that does every body who files I-824 has to go through NVC or in case of Canada we can go to consulate and start the case?
3-If NVC is involved in my case then how long file will stay at NVC and how long the consulate in Toronto will take to complete the process.

given the priority date and the processing dates i want to understand how the uscis will process our applications
now the Nebraska service center is processing June 8, 2008. so based on the priority date it is processing all the applications that are current and have been filed before June 8th. Now let us say they take an application and start processing it and suddenly the PD goes back and I am not current any more - what do USCIS do. Do they just stack it back or what do they do. any thoughts.

I Left Company A on April 27, 2004. Joined Company B on April 28 through H1b Transfer as CompanyB told me that they have filed H1b transfer documents. Got H1b Approval in Few months; , The H1b approval notice shows a receipt date of May 15. CompanyA never reported my job termination to INS. Now i have left Company B and joined Company C. Can anyone comment on consequence of this 17 days gap on GC prospects and What is considered my employment start date for companyB and employment end date with CompanyA.

Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?
