Hi..
i am currently on my 8th year h1..and on the bench..hoping some projects will come thru in a week or so.
Currently i have been on LOP for almost 5 weeks now..
what do you think would be a good option for me:
a.) Start the process for H4..and find a new job..and transfer H1 and stay till H1 is valid till may 2010..
b.) Be on bench for few more weeks.. and hope someting will work out...(firm has said they wont cancel my h1/140).. they are just being helpful..but?
c.) R2I ASAP...and try for a consular processing....?
d.) go to H4...and R2I in May...then if the Eb2(Dec 2005) dates are current..try for a CP..its a long shot...
i am confused..any suggestions??

The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number.
They stress and bolded "Earlier Than" so i am not IN???? :confused::confused::(:(

I should have elaborated this more. I read that ppl applying for H1B stamping were asked about this. They were actually issued 221 G and were asked to furnish extra documents and this was one of them.
I have no clue what is this and if this applies to everyone. I even found that ppl were asked to furnish notarized list of employees along with tax returns of the company. I hope this is not valid for every case.

I am currently on H-1B and filed for Adjustment of Status. I filed my I-485, AP, & EAD in August 2007. I got my EAD and AP in 2007 and it expired last year as well. I did not use the AP. I am with the same employer that filed my green card application. I am continuing on H-1B and did not use EAD.
My H-1B is valid till April 2010. I have not applied for the extension of my EAD & AP. The H-1B stamp on my passport expired in August, 2007. Also, my passport is valid till October 2009. My wife is on H-4 and the visa stamp on her passport also expired in August 2007. Her H-4 is also valid till April 2010. I am planning a trip to India in the coming month.
I wanted to know the process for my travel to India at this time on H status. Should I follow the standard procedure to file for H-1B renewal stamping at Indian embassy in India. Do I need to apply for passport renewal now since I have 8 months before it expires. Is it true that now it takes 4 work days to get the visa stamp in Canada.
Your help in answering this would be really appreciated.

Just by having papers or reco letters is not good enough for NIW. Infact NIW is made tougher in recent times. Proving that work is in national interest in the most difficult part and cases are rejected due to this reason. If you are from India NIW would only save you couple of months of PERM work. EB2 is retrogressed. NIW was useful when labor certifications used to take sevaral years. If you are from india and you think you are really extraordinary and exceptional in your field, then go EB1. It is current now.if you have to apply in EB2 only then use the perm process. It is fast now.

If you don't intend to change your employer, you can travel on AP, comeback and continue working on H1B.

Hi,
There is likely to be a change in my reporting manager. My current reporting manager will still be in the company in a new role, but I will be reporting to a new manager.
My PERM application (LC) was filed in mid Jan '09, and is still being processed. I would like to know if this will affect my PERM application in any way.
Nothing else has changed since i took up this position, same title, salary, location etc.,

after you recieve the EAD card you have to apply for SSN at your local SSN office.the time period to recieve SSN is different in different states.i guess the minimum time is 15 business days. please correct me if I am wrong.

For my I-140 (Premium Processing) USCIS's website is showing that they have sent a mail requesting more information on March 27th. Does anyone konw how long it takes to get to the lawyer's office? Para-legal at my lawyer's office told me that it takes about 14 days for that to reach them.
At the same time she told me that they give 30 days (she was not sure) to respond.
Can anyone please confirm this.

I have an approved i140 from old employer, using which I am planning to file i485 (As PD from old PERM/i140 is current for the month of Aug. & no labor filed for ne employer). As I am in good terms with old employer, they are ready to give me a "future employment letter" for my GC processing.
Can someone please let me know -
1. Format of the letter, details thats needs to be present in it,
2. Anything else I need from the old employer.

Depends, is the job offer/position still open? Do you intend to go back to your old company when you get the GC? If not, it is illegal to file 485 (by means of fraud) using the old i140.
If legal, I guess the job offer should just state that the offer is contingent upon getting your permanent residency.
PS: I have no experience in "future offer letter", but making a guess based on the offer letter I got when I had not yet got my H1.

Contact a good attorney asap. Your details would most probably raise anyone's eyebrows at USCIS/DOS/ICE. Also, a lot depends on exact dates when you entered/left US and when your different applications were rcvd by respective govt egencies as these details will help you to establish that you are not in violation of any US laws. Why not pick out one or two of your favorites (or perhaps instead, images that are technically fine but that you don't like and aren't sure why) and post them here? I'm sorry, but I certainly won't be taking the time to wade through a gallery of hundreds of images that look almost exactly the same, let alone writing critiques for each one (which is what I assume you were asking for, having posted your site in this particular forum).

I was wondering how the engine is calculating the scaling of the image to change the ViewPort, while zooming in and out. Does the change of ViewPort and the image composition within it depends only on the viewport width?
I have not able to find much greater details on this yet from MS. Would you be able to direct me please to some materials to understand more on Multiscale image control and its working in and out.
