I am currently in the US on L1 Individual visa - my current visa is expiring on the 28st of Feb. My employer filed for a fresh L1 Blanket Visa instead of doing an extension because I had RFE's on i94 extn. My visa interview is on the 23rd of Feb in Canada.
Am I going to have any problems because I did not extend my visa and applied for a fresh one instead?
Any delay due to PIMS? Do I need to check whether my petition number is in PIMS system?
Any information provided is greatly appreciated.

Hi..
I came to US on H4. My H1B got approved when i was in India. But I came through H4 only.
Now i want to change H4 to H1B. If i want to apply for change of status..do i need to go back to india(ot other countries) for stamping? Or can i get H1B staying here?
Please help..

Hi, I just got my 3 Years extention and planing to co ouside of us. I know I need to get the visa stamped. I need to know where should I start. Do I have to cotact the embassy forst. Thank you for your help.

Hello all:
Applied for 140 transfer TSC June 2007. Have not heard anything since, I mean absolutely nothing. Is this due to the backlog?? I am starting to get worried as I checked my status and all it says is, the received date and that when there is update they will let us know.
Did any of you apply 140 transfer in TSC around that time? Any news on those? Any case that it could've been lost?
Big question to the experts is, what do I do to make sure they are working on it and my application is in queue.

What do you mean by transfer. You can not transfer I140, you can only port the PD.

graduated with a MS in Computer science in may2007.
i applied to another university and got my sevis transferred to do my MBA there.
i have done 11 months 20 days of full time CPT at the previous university(where i did my MS).
am i eligible for another full time CPT at my new university where i have started my MBA (from jan 21st 2008)?
the international students service at my previous university is saying "i am eligible for 12months of full time CPT for every educational level, and i cannot get another 12 months if i do MBA because it is a masters degree too".
please suggest.

Hello All,
For the Visitors Visa(for parents), can a photocopy of Pay-check's be sufficient. Since the last few pay-rolls, my employer is giving everybody a photocopy of the Pay-check from Pay-chex Inc.To reduce costs of printing and mailing the Pay-checks, My employer is asking Pay-chex Inc to email the Bi-weekly pay-rolls of everybody.
Wondering if the US Embassy in India would create an issue by not bringing the original Pay-stubs.

Great tip from AILA for our H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) filers trying to beat the rush. Because you cannot submit an LCA earlier than six months prior to the beginning date of the period of intended employment (20 CFR � 655.730(b)), if you want your LCA in hand before April 1, then set your employment start date on the LCA for a date in September, and set the expiration date for a date no more than three years hence. File the I-129 with a start date of October 1, but with an expiration date that coincides with the expiration date of the LCA. You will lose a couple of days on the back end of the petition by doing this, but you will get the LCA filed and back before April 1.
Example:
LCA start date: 9/1/10
LCA end date: 8/31/13
Form I-129 start date: 10/1/10
Form I-129 end date: 8/31/13
Due to delays in receiving approved LCAs, take the proper precautions and file your LCA early to avoid any undue delays.
Although under certain circumstances USCIS has agreed to accept H-1B petitions for processing that include LCAs that have not been certified, attorneys should understand that if the LCA submitted with the H-1B petition is eventually denied, the H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) will be denied, even if a subsequent certified LCA is submitted. Hi All,
We have applied for 485 in July 2007(SELF+SPOUSE+KID). Bcoz of the issue with Fee, my son's 485 packet was sent back. Meanwhile, me and my spouse got our FP notices and we did them at nearest ASC.
My Lawyer corrected the fee and sent my son's 485 back to USCIS and was accepted. I got his reciept numbers in Dec 1st week. My son is 16 months old and we did not recieve his FP notices yet.
Do we receieve FP notices irrespective of the age or do we have any relaxation of kids under a certain age..Any one has any experiance..please share..Appreciate it..

Yes, the numbers are fixed. Therefore, those who filed in July and August, which were not given number from FY2007 will get from FY2008. And that would be too many for countries like India and China.

If I take a training course from Sun microsystems by paying them when I am on H4, is it illegal?
Technically, before October 1st - there is no employee-employer relation. It can be a trainer-trainee relation like Sun example above.

Hi,
My company applied for my H1B extn and after 3 months the status got changed to RFE... when the company lawyers recieved the letter, they reviewed it and emailed me the text below....
"Our office just received the Request for Additional Evidence from CIS by mail. What they requested in the letter is not applicable to your case and we believe CIS issued this RFE by mistake. We will respond to CIS to clarify this issue and will keep you informed if there is any update."
I have requested my company lawyers on the specifics...
Is it even possible to get an RFE by mistake? - (may be - yes)
have you seen any such instances?

-> I entered country on B1 and I applied for H1 through other employer. H1 got approved but change of status is denied as i left the country while petition was with USCIS.
-> I entered country on B1 again with new employer who applied my H1. My I94 validity ended on October 24th and we applied for extension due to some show stopper. Application is still in process.
Here are my questions -
1. Can i apply for change of status now or do i need to go back to India?
2. Now that i applied for extension, if i go for stamping at India immediately, will it be positive? Just because, i stayed for almost around 8 months in US this year. I was just wondering, will they reject it raising doubts on my intent? No one can decide on it, but what are the chances?
3. Staying in Canada on work permit for 6 months and then leaving to India for 3 months and then go for stamping, is this a better option?

My company is using substituted labor for me and applying for 140 and 485. My original LC which was pending just got approved. But the physical documentation is not there.
But my company is saying that they will also apply for 140 for the original LC also. How is this possible? I'm confused. What will happen to the 485 (and the first 140) when they file second 140?

Should be out by at latest the 15th... the bulletins in the past have been released in a range between 5th to 15th of the month.
I think with the Columbus Day holiday recently, they might take an additional day to release.
